Terms and Conditions – GolfImprove

1. General Information and Applicability

These Terms and Conditions apply to all offers, orders, agreements, and deliveries from GolfImprove, registered in Apeldoorn, The Netherlands:

By placing an order or using our services, you agree to these Terms and Conditions. GolfImprove reserves the right to update these terms at any time. The version applicable to your order is the version published at the time of your purchase.

2. Products and Offers

All product listings and prices on our website are subject to availability. GolfImprove reserves the right to refuse or cancel orders in cases of pricing errors, stock unavailability, or suspected fraud. In such cases, you will be notified promptly and any payment made will be refunded in full.

Prices are displayed in Euros (EUR) and include VAT unless stated otherwise.

3. Order and Agreement

An agreement is concluded when GolfImprove confirms your order by email. GolfImprove reserves the right to refuse orders without stating a reason.

4. Right of Withdrawal and Returns

As an EU consumer, you have the right to withdraw from your purchase within 14 days of receiving the product, without providing any reason, in accordance with Directive 2011/83/EU. Full details are set out in our Return Policy, which forms part of these Terms and Conditions and is available on our website.

5. Prices and Payment

  • All prices are in Euros (EUR) and include applicable VAT
  • Payment must be completed at the time of ordering
  • GolfImprove accepts payment via the methods listed at checkout
  • In the event of non-payment, GolfImprove reserves the right to suspend or cancel the order and charge statutory interest and reasonable collection costs in accordance with Dutch law

6. Delivery and Shipping

  • GolfImprove will fulfil orders within the timeframe indicated on the product page or at checkout
  • If delivery is delayed, you will be notified as soon as possible
  • Risk of loss or damage to products passes to you upon delivery
  • GolfImprove is not responsible for delays caused by third-party carriers or circumstances beyond our control

7. Legal Guarantee and Conformity

All products sold by GolfImprove are covered by the statutory 2-year legal guarantee under Dutch and EU law (Article 7:17 Dutch Civil Code). If a product does not conform to the agreement at the time of delivery, you are entitled to repair, replacement, or a refund at no cost to you. Please contact us at info@golfimprove.eu to make a claim under this guarantee.

8. Liability

GolfImprove's liability for damages is limited to the amount paid for the product or service in question. GolfImprove is not liable for indirect or consequential damages, unless caused by intent or gross negligence on our part.

Nothing in these Terms and Conditions limits or excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence.

9. Complaints

If you have a complaint about a product or our service, please contact us first at info@golfimprove.eu. We will respond within 14 days of receiving your complaint. If we are unable to resolve the complaint together, you may submit your dispute to the Dutch Disputes Committee (Geschillencommissie) via www.degeschillencommissie.nl or use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

10. Intellectual Property

All intellectual property rights in materials provided by GolfImprove, including website content, product images, and marketing materials, remain the property of GolfImprove. Reproduction, distribution, or use of these materials without prior written permission is prohibited.

11. Privacy

GolfImprove processes personal data in accordance with the GDPR and applicable Dutch privacy law. Please refer to our Privacy Policy on our website for full details.

12. Governing Law and Disputes

These Terms and Conditions are governed by Dutch law. Disputes arising from this agreement will be submitted to the competent court in the district of Gelderland, The Netherlands, unless mandatory consumer protection law provides otherwise.
